The status of gig-economy couriers has been litigated repeatedly. In Uber BV v Aslam [2021] UKSC 5 the Supreme Court held that Uber drivers were 'workers' under section 230(3)(b) of the Employment Rights Act 1996 - entitled to minimum wage and holiday pay - but the decision did not make them employees, and the courier-specific case law has gone in different directions for different platforms. Stuart, Deliveroo, Just Eat self-employed, Amazon Flex, Evri (formerly Hermes), DPD owner-drivers, Yodel Neighbourhood Couriers - each operates a different contractual model, and the question of whether the platform owes a duty of care to the courier after a non-fault accident depends on the precise terms. For most couriers, however, the practical question is simpler: who pays for the lost income while the vehicle is off the road, and the answer is normally the at-fault third party's insurer through the non-fault claim, not the platform.
Courier work is hire and reward, and standard car or van insurance does not cover it. Specialist courier insurance - written by Zego, Quotax, Insure 4 a Day for short-term cover, Acorn, Tradex and others - bundles H&R motor cover with goods-in-transit (GIT) cover for parcels being carried. GIT limits typically run from £10,000 to £25,000 per load with single-item caps. After a non-fault collision the parcels themselves may be damaged, and the courier's first call is normally the platform (Amazon Flex, DPD, Evri) to report the load condition. Where the platform writes off the parcel value and pays the consignor, that recovery does not affect the courier's separate motor claim. Where the platform refuses to pay and the courier carries personal liability under their contractor agreement, the GIT policy responds, and we coordinate the dual claim path.

Couriers can evidence earnings precisely from platform statements. Amazon Flex provides a daily block summary; Evri provides a weekly self-employed driver statement; DPD owner-drivers receive a franchisee statement; Stuart and Gophr export per-delivery data. We ask for the previous 8-13 weeks of statements as the baseline and calculate net income after fuel, vehicle financing, insurance and the standard self-employed running cost ratio. Multi-drop routes generate piecework income that varies by day of week and time of year - a Christmas-week DPD round can be three times a March round - so we apply seasonal adjustment based on the same week in previous years where data is available. Lost-earnings claims that ignore seasonality systematically underclaim by 10-20% across the typical off-road period.
A multi-drop courier vehicle takes more wear in a year than most cars take in five. A Berlingo or Caddy running 150-200 drops a day, six days a week, accumulates 50,000-80,000 miles annually with continuous low-speed manoeuvring stress on the clutch, brakes and suspension. The pre-accident value (PAV) on a high-mileage courier vehicle is often near or below the cost of even minor structural repair, so write-off thresholds bite more frequently than on standard vehicles. Insurers reference Glass's Guide and CAP, but for a 100,000-mile-plus courier van the trade buying price is dispersed widely and we typically need three retail comparables from Auto Trader or Motors plus the courier's service record to support a fair PAV. Where the vehicle is written off, the courier needs replacement within 24-48 hours to avoid losing their slot with the platform.
Most courier platforms will suspend an active courier within 24-72 hours of receiving an accident notification, pending confirmation that the vehicle is repaired or replaced and that the courier remains insured. Amazon Flex reallocates blocks immediately; DPD owner-drivers face route reassignment if the franchisee cannot field a replacement; Evri reassigns parcels to neighbouring rounds. We assist the courier with the documentation needed to keep the slot - engineer's report, insurance certificate covering the replacement, photographs of the replacement vehicle's licence plate and condition. Where the off-road period exceeds the platform's tolerance and the courier loses their round permanently, that loss is recoverable as consequential loss under the McGregor on Damages line of authority, provided we can document the realistic chance of retention had the accident not occurred - usually through the platform's published reallocation policy.
